What is a class action?
A class action is a legal claim brought by a group (class) of people against a particular defendant or defendants in respect of the same subject matter. Here, the proposed group (class) of people are the owners of buildings constructed in New Zealand within the last 4 years (since 2012). Participating in a class action means resources can be pooled together to pursue a claim (on behalf of all owners) without having to incur the costs of many individual claims.
Is the action funded?
Harbour Litigation Funding has provided initial funding for the Steel Class Action. Registration will enable the team at Adina Thorn Lawyers to assess the viability of the claim. In order to progress the claim we are hoping for a good response from owners wishing to participate.
What is the cost of being involved / registering?
There is no cost for registering, or at any stage in the process should it progress. All the legal and other costs are worn by the litigation funder on behalf of the claimants. If the claim goes ahead, owners stand to receive a percentage share of the judgment or settlement sum after legal and other costs, and the funderís share, are deducted.
Who is funding the action?
Funding arrangements are currently being finalised with Harbour Litigation Funding. Harbour is also the funder of the NZ$250M class action against the James Hardie group of companies.
What remedy are you seeking?
We intend to seek compensation from the manufacturers of Grade 500E Steel Reinforcing Mesh.
Should I be concerned about the quality of the steel mesh installed in my building?
